Accenture has made available FOUNDATION Website, an electronic information delivery system via the World Wide Web (WWW) on the Internet. FOUNDATION Website is available for users of FOUNDATION products who are entitled to receive maintenance services under a maintenance agreement between a Client and Accenture. The user agrees that its use of FOUNDATION Website will be governed by the license agreement between Accenture and the Client.

FOUNDATION Website will provide Client with access to certain product enhancements, fixes and other similar product related information and materials which it is entitled to receive under its maintenance agreement (the "Download Materials"). Client agrees that the Download Materials will be considered a Product according to the terms and conditions of the Agreement. It will be Client's responsibility to ensure that it receives complete copies of the Download Materials and that there were no data transmission errors. Client will also be responsible for adequate backup and recovery procedures in the event of errors related to the transmission or content of the Download Materials.

Client may be allowed to transmit programs, files, data and other information to FOUNDATION Website ("Upload Information") to aid Accenture in diagnosing a problem encountered by Client related to FOUNDATION products. Client agrees that it will use reasonable commercial efforts to implement policies which are designed to reduce or eliminate the transmission of computer viruses and similar destructive software. Also, Client agrees that it and its employees will not transmit Upload Information to Accenture unless it and its employees have the right and internal approval to do so.

FOUNDATION Website allows Client to access certain electronic messaging features where Client may transmit and receive electronic messages to and from Accenture related to FOUNDATION products. Client will be solely responsible for the contents of any message it sends and Client will not send any message that contains confidential information or information which may be considered slanderous or libelous. Also, Accenture does not guarantee the accuracy of any information contained in electronic messages by other FOUNDATION Website users and Accenture will not be responsible for the content of any message received by Client from other FOUNDATION Website users.

Client agrees that if it transmits any information (other than Upload Information) to FOUNDATION Website, it waives any rights or claims related to such information and such information shall be considered a part of the public domain. Client agrees to be responsible for the items which its employees provide (such as Upload Information, messages and other information) and Client will indemnify and hold Accenture harmless against any liability related to such information.

Accenture provides FOUNDATION Website as a service to its FOUNDATION products clients entitled to receive maintenance and reserves the right to alter the form, content and structure of FOUNDATION Website or to eliminate the use of FOUNDATION Website entirely.

These Foundation Services use personal data, such as your email address and password to enable you to use and log into the Foundation Services Application/Portal. We may also collect information which identifies your device as part of our security processes, as well as your phone number in the event that we need to contact you regarding a request. Other than the aforementioned, no other personal data about you is collected or processed. We may transfer your personal data to any of our affiliates or service providers in order to furnish you with the Services, or fulfill a request. All such service providers are subject to contractual obligations in relation to the processing of your personal data.
